The term "Manson Guitar Works", "us" or "we" refers to Manson Guitar Works Ltd, registered in England and Wales under company number 08393645, whose registered office is Unit C2, Linhay Business Park, Ashburton, Devon, TQ13 7UP, United Kingdom. VAT registration number GB 109203842. The term "you" refers to the user or viewer of our website.
Use of this website
The content of the pages of this website is for your general information and use only, and is subject to change without notice. In particular, items shown in stock at any one time may not always be available and can become unavailable at short notice. We reserve the right to refund any payment and not supply the goods if they become unavailable.
Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. Prices and payment
Prices are shown in UK pounds sterling and, for customers in the United Kingdom, include VAT at 20% where applicable. Orders delivered outside the United Kingdom are zero-rated for UK VAT, and prices shown to those customers have UK VAT removed. Import VAT, customs duty and carrier clearance fees may be charged by the destination country and are the responsibility of the recipient — see our Shipping Policy.
We accept the payment methods shown at checkout, including major debit and credit cards. Bank transfer can be arranged for some orders by agreement - contact sales@mansonguitarworks.com. We do not accept cheques. If you are shopping from outside the UK, your bank may convert the transaction to your own currency at a rate we do not control, and may charge a fee for doing so. Payment must be received in full and funds cleared before goods are dispatched.
Delivery schedule
Our aim is to process orders as quickly as possible. However, many items offered for sale by Manson Guitar Works are custom builds or long lead-time items, and in most cases we can only give estimates for delivery times. We will inform you by email when goods have been dispatched. Delivery timescales, services and costs are set out in our Shipping Policy.
Back orders, stock levels and cancelling an order
We aim to keep our website up to date, but stock levels are not always completely accurate. If an ordered item turns out to be out of stock, we will notify you and you may:
- accept the delay in receiving the goods;
- accept an agreed alternative item (the price will be adjusted if the alternative is of a different value); or
- cancel the order and receive a full refund.
Returns and cancellation
Your right to cancel, return goods and obtain a refund is set out in full in our Refund and Returns Policy, which forms part of these terms. In summary: consumers have 14 days from receipt to cancel, except for goods made to your specification or clearly personalised; and separate rights apply where goods are faulty, damaged or not as described.
WEEE — recycling your old electrical items
You can recycle your old electrical items with us. If you are buying a new electrical item, we will recycle your old one free of charge on a like-for-like basis. Please arrange this in store at Manson Guitar Works Ltd, Unit C2, Linhay Business Park, Ashburton, Devon, TQ13 7UP.
Unwanted electrical equipment is the UK's fastest growing type of waste. Many electrical items can be repaired or recycled, saving natural resources and the environment. Equipment that can be recycled is marked with a crossed-out wheeled bin symbol - please do not put it in your household bin. You can find more information on WEEE recycling, and locate your local recycling centre, at www.recyclenow.com.
Terms and Conditions of Sale
1. Definitions
1.1 "Buyer" means the individual or organisation who buys or agrees to buy the Goods from the Seller.
1.2 "Consumer" has the meaning given in section 2(3) of the Consumer Rights Act 2015.
1.3 "Contract" means the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these Terms and Conditions.
1.4 "Goods" means the articles that the Buyer agrees to buy from the Seller.
1.5 "Seller" means Manson Guitar Works Ltd, Unit C2, Linhay Business Park, Ashburton, Devon, TQ13 7UP, registered in England and Wales under company number 08393645.
1.6 "Terms and Conditions" means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller.
2. Conditions
2.1 Nothing in these Terms and Conditions shall affect the Buyer's statutory rights as a Consumer.
2.2 These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.
2.3 Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.
3. Ordering
3.1 All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller.
3.2 Where the Goods ordered by the Buyer are not available from stock, the Buyer shall be notified and given the option to wait until the Goods are available, order a replacement item agreed with the Seller, or cancel the order and receive a full refund within 30 days. In the case of special orders and custom work, many items on this site will not be in stock as they undergo further work or modification before sale.
4. Price and payment
4.1 Prices are exclusive of delivery. For delivery within the United Kingdom the Price is inclusive of UK VAT. For delivery outside the United Kingdom the Price excludes UK VAT, and import taxes and duties in the destination country are payable by the Buyer.
4.2 The total purchase price, including any VAT and delivery charges, will be displayed in the Buyer's shopping cart prior to confirming the order.
4.3 After the order is received the Seller shall confirm by email the details, description and price for the Goods, together with information on the right to cancel where the Buyer is a Consumer.
4.4 Payment of the Price plus any VAT and delivery charges must be made in full, and funds cleared, before dispatch of the Goods.
5. Rights of the Seller
5.1 The Seller reserves the right to adjust the price and specification of any item on the website at its discretion.
5.2 The Seller reserves the right to withdraw any Goods from the website at any time.
5.3 The Seller shall not be liable to anyone for withdrawing any Goods from the website or for refusing to process an order, save that where payment has been taken it will be refunded in full.
6. Warranty
6.1 The Seller warrants that the Goods will at the time of dispatch correspond to the description given by the Seller.
6.2 Where the Buyer deals as a Consumer, the Buyer's rights under the Consumer Rights Act 2015 - including that Goods be of satisfactory quality, fit for purpose and as described - apply in full and are not limited by these Terms.
6.3 Except where the Buyer deals as a Consumer, all other warranties, conditions or terms relating to fitness for purpose, merchantability or condition of the Goods, whether implied by statute, common law or otherwise, are excluded, and the Buyer is satisfied as to the suitability of the Goods for the Buyer's purpose.
7. Delivery
7.1 Delivery estimates will be given upon receipt of each order.
7.2 The Seller shall use reasonable endeavours to meet any date agreed for delivery. Except where the Buyer deals as a Consumer, time of delivery shall not be of the essence and the Seller shall not be liable for any losses, costs, damages or expenses arising directly or indirectly out of any failure to meet an estimated delivery date.
7.3 Delivery of the Goods shall be made to the Buyer's address specified in the order, and the Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.
7.4 Where the Buyer supplies an incorrect or incomplete delivery address, or fails to take delivery or to pay import charges due, any additional carriage or return costs incurred shall be payable by the Buyer.
7.5 Risk in the Goods passes to the Buyer on delivery. Title in the Goods passes to the Buyer once the Seller has received payment in full.
8. Cancellation and return
8.1 The Buyer's right to cancel and return Goods is set out in the Seller's Refund and Returns Policy, which forms part of these Terms and Conditions.
8.2 The Buyer should inspect the Goods on receipt and notify the Seller by email or in writing, with photographs, within 48 hours of receipt if the Goods appear to have been damaged in transit, retaining all packaging. This assists the Seller in making a claim against the carrier and does not limit the Buyer's statutory rights.
8.3 Where a claim of defect or damage is made, the Goods shall be returned by the Buyer to the Seller. The Buyer shall be entitled to a full refund, including delivery costs, plus reasonable or agreed return postage, if the Goods are found to be defective.
8.4 Goods to be returned must clearly show the order number obtained from the Seller on the package.
8.5 Where returned Goods are found to be damaged due to the Buyer's fault, the Buyer will be liable for the cost of remedying such damage.
9. Limitation of liability
9.1 Nothing in these Terms and Conditions limits or excludes the Seller's liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.
9.2 Subject to clause 9.1, and except as may be implied by law where the Buyer deals as a Consumer, in the event of any breach of these Terms and Conditions by the Seller the remedies of the Buyer shall be limited to damages, which shall in no circumstances exceed the Price of the Goods, and the Seller shall not be liable for any indirect, incidental or consequential loss or damage.
10. Waiver
No waiver by the Seller (whether express or implied) in enforcing any of its rights under this Contract shall prejudice its right to do so in the future.
11. Force majeure
The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock-outs, accidents, war, fire, breakdown of plant or machinery, or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations. In particular, where items are sold indicating the inclusion of an endorsement or certificate from an artist relating to one of our products, Manson Guitar Works Ltd shall not be liable for any loss arising from the inability to provide such endorsement or certificate if the artist cannot or does not wish to comply with their obligations. Where delayed, the required endorsement or certificate may follow at a later date.
12. Severance
If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, such provision shall be severed and the remainder of the provisions shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.
13. Changes to these Terms and Conditions
The Seller is entitled to alter these Terms and Conditions at any time, but this right shall not affect the Terms and Conditions accepted by the Buyer upon making a purchase.
14. Governing law and jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the law of England, and the parties submit to the exclusive jurisdiction of the English courts. Where the Buyer deals as a Consumer resident elsewhere, this does not deprive the Buyer of the protection of the mandatory consumer law of their country of residence.
